Gomera Cycling Terms & Conditions

 

Definitions: 

 

In these Terms & Conditions, the following terms shall have the meanings indicated:-

“GC” means Gomera Cycling.

"Customers" means individuals or entities who use this website or the services of the GC or who undertake any other business with GC;

"Privacy Policy" means our statement of practice as regards the privacy and security of your information when accessing and/or using this website and any of the features hereon;

"Service(s)" means the services to be provided by GC

"Terms & Conditions of Use" and "Agreement" means the terms and conditions of Company as referred to and/or contained herein;

"you" means any and all persons accessing or using this website and/or availing of any information and/or services available on or via this website;

"we" and "our" and "us" means GC.

"EFT" means Electronic Funds Transfer

"EHIC" means European Health Insurance Card

What’s Included:

Generally includes accommodation in 4 star Hotel, transfers and guided cycling. Details are as specified on our website and may be amended from time to time.


 

Transfers:

 

Complimentary transfers are arranged by GC to tie in with specific arrival/departure dates and times. If you arrive or depart outside these dates/times then you may incur additional charges (only in Tenerife) if you are unable for any reason to avail of GC's standard transfers in La Gomera GC will cover the cost.

 

Insurance:

 

Adequate and valid travel insurance is compulsory for all Gomera Cycling travellers and it is a condition of accepting your booking that you agree you will have obtained adequate and valid travel insurance for the duration of your holiday by your date of arrival.

Payment:

 

Payment can be made by electronic funds transfer (EFT) into our account or by major credit/debit cards.

 

 

 

Deposit: 

 

A deposit of €150 is required to confirm any booking. If you decide to cancel your holiday within 10 days of payment of your deposit we will refund your deposit. After 10 days of payment date the deposit is non-refundable. The balance is due 1 month prior to your holiday. If you do not pay the balance your holiday will be cancelled and you will lose your deposit.

 

Payment in STG: 

 

All GC prices are in Euros but we will accept payment in £Stg using Transferwise. For details see our website here.

Single Occupancy Premium: 

 

GC use third parties to provide accommodation. Prices are based on two people sharing accommodation. If you wish to book a holiday as a single occupant additional charges may apply. Details can be found on our website and booking form and may be subject to change from time to time in line with changes in cost to GC from accommodation suppliers. 

 

Declaration: 

In booking your holiday with GC you are accepting that you fully understand that your cycling holiday involves a certain level of risk as it entails cycling over uneven ground, negotiating, ascending and descending steep paths. You are taking full responsibility for ensuring that your level of fitness and ability is adequate for the cycling you undertake. GC accepts no responsibility, obligation or liability whatsoever in this respect.

 

EHIC Health Card: 

 

If you are entitled to an EHIC (most EU citizens) GC require that you bring this with you on your holiday. In making your booking you undertake to apply for this card and bring it with you.

 

Cancellation Policy:

 

All deposits are refundable if you notify us of your desire to cancel within 10 days of payment of the deposit. After 10 days the deposit is non-refundable. If you wish to cancel your holiday after paying the balance (i.e. within 1 month of your holiday) then the entire payment is non-refundable.

 

Third Party Services:

 

GC accepts no responsibility and shall not be deemed liable for supply of services by third parties not under the management or control of GC.

 

Force Majeure:

 

GC is not liable for failure to perform its obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, acts of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service. 


 

Gomera Cycling right to decide: 

 

Your safety is paramount and GC reserves the right to decide at their sole discretion, taking into account weather and other conditions whether or not to cycle and what rides to undertake. Each client is responsible for deciding if their level of competence and fitness are adequate to undertake a particular ride. GC acts solely in an advisory role if requested for information on any particular ride.

 

Late arrival: 

 

If your flight is delayed (or you miss your flight) and arrive later than 12:30PM on the tour commencement date GC reserves the right to make alternative ferry/transfer arrangements on your behalf and if additional costs are incurred as a result, you agree to reimburse GC such costs.

 

Privacy Statement: 

 

In compliance with the Data Protection Act of 1998 GC take a responsible approach to all areas of our business including protection of your personal information. 

In order to process your booking, we need to collect certain personal details from you on our online booking form and ancillary emails e.g. names and addresses, passport numbers, DOB, and special requirements.. If we need any other personal details, we will tell you before we obtain them from you. We need to pass on your personal details to the companies and organisations that we work with (for example your hotel and the Ferry companies) on a need to know basis so that we can effectively arrange your holiday.

Apart from the exceptions outlined above, we will keep all personal details you give us in connection with your holiday absolutely confidential. We do not sell or pass on for marketing purposes any information you pass to us. Both Gomera Cycling and the internet service provider which hosts our site, strive to maintain appropriate security measures in our respective physical facilities to protect against the loss, misuse or alteration of information that we have collected from you to make your holiday booking.

We may from time to time, contact you with information about Gomera Cycling. If you do not wish to receive such information, please inform us and we undertake to remove your name and all personal data from our mailing lists and database.

Governing Law:

These terms and conditions and any other agreements or arrangements between the parties shall be governed in accordance with Spanish law and the parties submit to the exclusive jurisdiction of the courts of Spain.
